General terms and conditions for the use of the Drama.si/en website

These General Terms and Conditions for the use of the Drama.si/en website (hereinafter: the General Terms and Conditions) shall apply to all users and all forms of use of the Drama.si/en website (hereinafter: the Website or Drama.si/en). The Website shall be designed, maintained and made available to the public for the purpose of disseminating general information, copyrighted content and audio visual works, and for the marketing and sale of services and goods.

By visiting the Website, you confirm that you are familiar with the entire content of the General Terms and Conditions, that you accept the aforementioned document in full in its currently valid form and that you are bound by the provisions of the General Terms and Conditions. If you do not agree with the General Terms and Conditions or any part thereof, you are requested to stop accessing the Website immediately.

Use of the services provided by the Website is at your own risk. All provisions of the General Terms and Conditions shall apply equally to all users, except in the cases expressly stated otherwise in the General Terms and Conditions.

Services shall be available 24 hours a day, every day of the year. The Service Provider shall reserve the right to amend, or temporarily or permanently disable any or all stated functionalities without prior notification.

These General Terms and Conditions shall be linked to the valid laws of the Republic of Slovenia. The court in Ljubljana shall be competent for resolving disputes and disagreements that arise in connection with the Website and for which all other extrajudicial means of reaching agreement have been exhausted.

Any provision of the General Terms and Conditions that is deemed invalid or unenforceable according to currently valid legislation in the Republic of Slovenia shall be replaced with a valid and enforceable provision that best suits the purpose of the original provision. The other provisions of the General Terms and Conditions shall remain valid in their unchanged form.

These General Terms and Conditions shall be regularly updated and the valid version thereof accessible on the Website.

DEFINITION OF TERMS

The General Terms and Conditions for the use of the Drama.si/en website shall serve as a legally valid, binding and irrevocable agreement between the Service Provider and users of the Drama.si/en website.

Drama.si/en is a website that disseminates information, markets goods and services, and offers other related website services at the domain www.drama.si/en. The service provider may amend the domain address of the website. However, the General Terms and Conditions shall remain valid in full.

Unless otherwise stated, the provider of the website services, the owner of content, and the owner and administrator of software applications and associated service activities shall be the public institution, the Slovenian National Theatre Drama Ljubljana (SNT Drama Ljubljana), Erjavčeva 1, 1000 Ljubljana.

Users of services include all legal entities or natural persons who use any of the Website’s services.

RESTRICTIONS ON USE

The Drama.si/en website may only be used for personal and non-commercial purposes. Unless otherwise stated in these General Terms and Conditions, the following is prohibited: the amending, copying, distributing, broadcasting, presenting, performing, reproducing, licencing, transferring or selling of any data, software, products or services that are part of the website.

COPYRIGHTED CONTENT

The content and materials published on the website are copyrighted works, and are the property of the Slovenian National Theatre Drama Ljubljana, and/or its partners and contracted co-workers. The aforementioned content and materials also include computer code, the established structure and form of the website, and written, visual, audio and other materials on the website. All rights are reserved.

In the event of the breach of copyrights or intellectual property rights, the Service Provider may take action against violators in accordance with the law.

Information and materials may only be copied, distributed or amended with the Service Provider’s written permission. Contact drama@drama.si to obtain permission.

Claims in connection with copyrights shall be resolved in accordance with the Copyright and Related Rights Act and the Civil Procedure Act.

LINKS

With the Service Provider’s written permission, you may link the Drama.si/en website to other websites whose content is not in contravention of the law or generally accepted moral standards.

The website contains links to various external sites such as other websites, individual pages or other sources over which the service provider has no influence whatsoever, and is thus not liable for accessibility to, the content of or errors relating to such websites, pages or sources. Users shall be bound by the general terms and conditions governing the use of external websites.

LIABILITY

The service provider shall not be liable for damage that might arise due to unauthorised or illegal interference with the website by third parties, including potential viruses. Users are responsible for providing their own anti-virus protection.

Website users guarantee that they will not cause disruptions on the website, or use or interfere with the website in a way that is in contravention of the law or these General Terms and Conditions.

The Website may not be used in a way that would render it inoperable or overburden it, or cause damage to it or the public institution SNT Drama Ljubljana. Preventing or limiting the use of the Drama.si/en website by other users is prohibited. Gaining unauthorised access to any service offered by the Drama.si/en website, the computer system and the associated network and data is also prohibited. Obtaining materials or information by means that are intentionally unavailable within the website or expressly permitted for access as part of a privacy protection statement are likewise prohibited. If access to such data was facilitated due to an error in the services provided by the website, please report that error to drama@drama.si.

BREACH OF THE GENERAL TERMS AND CONDITIONS

The Service Provider may, at its own discretion, take one of the following actions against a user who breaches the provisions of the General Terms and Conditions:

• issue a warning regarding failure to comply with the General Terms and Conditions, and call on the user to ensure compliance;
• block access to specific services provided by the website;
• block the IP address from which a breach occurred; or
• forward the IP address from which a breach occurred to the competent authority, when so required by the law.

AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS

The Service Provider shall reserve the right to make occasional amendments to the General Terms and Conditions. Continued use of the website indicates that you agree with the amended General Terms and Conditions and that you accept them in full.
