General

1. The General Terms and Conditions of the SNT Drama Ljubljana online shop shall apply to all our offers and shall govern all agreements entered into and all purchase orders placed by buyer for the supply of goods and services provided by SNT Drama Ljubljana. By visiting the SNT Drama Ljubljana website, the buyer agrees to the General Terms and Conditions of Use of the website and to the Declaration on the Protection and Processing of Personal Data. By agreeing to use the SNT Drama Ljubljana online shop and by placing an order, the buyer accepts and acknowledges these General Terms and Conditions by ticking the appropriate box when making a purchase.
2. The General Terms and Conditions of the SNT Drama Ljubljana online shop are compiled in compliance with laws, especially the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).
3. The General Terms and Conditions define the operation of the SNT Drama Ljubljana online shop, the rights and obligations of the user and the shop, and govern the relationship between the SNT Drama Ljubljana and the buyer.
4. The buyer’s terms and conditions or any terms and conditions different from the General Terms and Conditions shall only be valid if specifically agreed to by SNT Drama Ljubljana in writing.
5. A confirmed agreement on a derogation of a particular provision from the General Terms and Conditions of the SNT Drama Ljubljana shall not affect the validity of any other provisions of these Terms and Conditions.

Access to information

1. The SNT Drama Ljubljana is committed to providing the following information to the buyer before completing a legally binding contract or offer:

• the information on the SNT Drama Ljubljana (name and registered office, registration number),
• the contact details to provide the buyer with fast and efficient communication (email, telephone),
• the main properties of the items (including after-sales service and guarantees), and until when the information is deemed valid,
• the product availability (each product offered on the website must be available within a reasonable period of time, except in the event of force majeure),
• the terms of product delivery (and a method, place and date of delivery),
• the prices must be clear, accurate and not misleading for buyers, must indicate whether taxes, transport and other charges are already imposed on the total purchase price, and state until when the information is deemed valid,
• the method of payment and delivery or completion of obligation, and until when the information is deemed valid,
• temporal application of the offer,
• the period within which the consumer has a right to withdraw from the contract, and the terms and conditions for withdrawal (description of the right of withdrawal in compliance with Article 43c of the Value Added Tax Act; if the buyer is exempt from the right of withdrawal in compliance with Article 43c of the Value Added Tax Act, the buyer shall be expressly informed thereof),
• the details on the complaint procedures, including full details of the contact person or customer service.

Offer

1. Accuracy of information: the SNT Drama Ljubljana makes every effort to ensure that the information published on the website is up-to-date and accurate; however, the properties of the products, delivery dates or prices may change, sometimes so quickly that the SNT Drama Ljubljana is unable to correct the information published online in a timely manner. In that case the buyer will be informed of the changes and given the opportunity to modify or cancel the order.
2. Product display. Although the SNT Drama Ljubljana is committed to providing you with the accurate photographs of products, all products shown are for illustration purposes. Photographs do not guarantee the properties of the product.
3. Non-operation of online shop during the annual summer holiday: during the annual summer holiday no purchase can be made online or at the SNT Drama Ljubljana box office.

Registration

1. Making a purchase: registration is required to make a purchase in the SNT Drama Ljubljana online shop as this is the only way for you to keep track of your orders and purchases.
2. Buyer’s commitment: by creating an account, the buyer undertakes that all the information submitted by him/her or by the person he/she authorises in writing before registering the account is complete and true. In the event of any deceptive inaccuracies in the buyer’s information, the SNT Drama Ljubljana reserves the right to immediately terminate any contract between the Online Shop and the buyer and, in the event of any monetary or material damage, to claim full compensation for expenses incurred.
3. Deleting a user account: to delete a registered user account in the SNT Drama Ljubljana online shop, please send a request to the following email address: spletna.prodaja@drama.si. Please, enter email subject line: Request to delete my account.
4. Legal entities. Account registration is required also for legal entities. The person making a purchase must tick a box stating that he/she is a legal entity and wishes to have the original invoice issued to a company.

Prices and VAT

1. All prices quoted on the supplier’s website are final prices. All prices are in euro net (EUR) and include the value added tax rate (VAT), unless explicitly stated otherwise. The price quoted for each product does not include delivery charges.
2. Prices are valid at the time of placing an order and have no predefined validity.
3. The sales contract between the supplier and the buyer is concluded at the moment a purchase order is confirmed and accepted by the supplier. From that moment on, all prices and other terms and conditions are binding for both parties, the supplier and the buyer.
4. A voluntary contribution, which can be made at the checkout after each order, is intended for the purposes of the services referred to in the Value Added Tax Act, Article 42 -1/13, and is exempt from VAT.

Orders

1. Acceptance of orders: the SNT Drama Ljubljana accepts orders via online shop.
2. Conclusion of the contract: The contract between the SNT Drama Ljubljana and the buyer in the SNT Drama Ljubljana online shop is concluded at the moment when the buyer receives the first electronic notification by SNT Drama Ljubljana that the order has been accepted. From that moment on, all prices and other terms and conditions are binding for both parties, the SNT Drama Ljubljana and the buyer. The buyer is a person whose details are provided at the time of placing an online order.
3. If the order has been placed and it is established that the buyer has intentionally caused SNT Drama Ljubljana monetary or material damage (e.g. ordering cash on delivery with no intention of paying or providing false personal information), the SNT Drama Ljubljana reserves the right to cancel the order and to claim full reimbursement of the expenses incurred.
4. Periodic discount codes: periodic discount codes provide various purchase benefits and are time-limited. They are product- or purchase-specific. Their use is always described in detail on the www.drama.si/en website. The periodic discount codes cannot be exchanged for cash.

Guarantee

1. The product is covered by guarantee if that is stated on the guarantee certificate or invoice. The SNT Drama Ljubljana guarantees that the product for which the guarantee has been issued will function faultlessly, in compliance with the guarantee terms and conditions and within the guarantee period. The guarantee shall be subject to the terms and conditions set out in the guarantee certificate accompanying the product. The SNT Drama Ljubljana guarantees faultless operation of the product for the guarantee period, from the date the product is delivered to the buyer. The guarantee period is one year or as long as indicated on the guarantee certificate. The buyer may claim guarantee by means of guarantee certificate or invoice that should be stored carefully.
2. The buyer’s rights arising from a guarantee are without prejudice to SNT Drama Ljubljana’s liability rules for product defects.

Material defects

1. The product has material defect:

• if the item does not have the properties necessary for its normal use or circulation;
• if the item does not have the properties necessary for a particular use for which the buyer is purchasing it, which was known or should have been known to the seller;
• if the item does not possess the qualities and properties which were expressly or tacitly agreed upon or defined;
• if the seller has handed over an item which does not correspond to a sample or model, unless the sample or model was displayed for information only.

2. The buyer must notify the SNT Drama Ljubljana and give a detailed description of the defect at spletna.prodaja@drama.si no later than two months from the date of discovery of the defect. The SNT Drama Ljubljana shall not be held liable for defects that occur after two years from the date of purchase. The buyer must allow the product to be inspected by SNT Drama Ljubljana.
3. If the buyer makes a product complaint within the first six months from receipt of the product, the SNT Drama Ljubljana bears the burden to prove that the complaint is unjustified, i.e. that the product is free from defects. If the buyer makes a product complaint after the expiry of six months from the date of the receipt of the product, he/she buyer must bear the burden of proof in the event of defect.
4. The decision as to which of the guarantee claims to pursue is solely the buyer’s and is not subject to any order of priority.
5. If the existence of a product defect is not disputed, the SNT Drama Ljubljana shall satisfy the buyer’s claim within eight days at the latest.
6. The SNT Drama Ljubljana must respond to the buyer’s request in writing within eight days of receipt of the request at the latest, if the existence of a product defect or an irregularity in the performance of the service is disputed.

Delivery of online orders

1. Order status: Normally, an order is processed and ready for dispatch within 3 working days. The buyer will receive a notification of the status of his/her products’ order or an invoice, which is deemed valid as a confirmation, to his/her email address.
2. Shipping costs: For all orders, the buyer pays a shipping charge of € 3.90.
3. Delivery: the delivery service is provided by Pošta Slovenija in compliance with its terms and conditions. The current estimate delivery time is 7 working days.
4. Personal pick-up. When the order is ready for collection, the buyer will receive a notification at the email address provided at the time of placing the order.

Refunds and safety

1. Order cancellation and modification: after placing the order, the buyer receives an email notification from the SNT Drama Ljubljana confirming that the order has been accepted. Within an hour of receiving this notification, the buyer has the option to cancel the order by sending an email to spletna.prodaja@drama.si. After this time, the order is already being processed and can no longer be cancelled. The buyer cannot change the content of the order after having placed it.
2. Invoice: An invoice will be sent by email to the email address the buyer has provided when placing an order. The buyer is kindly asked to check that the invoice did not go to spam. The buyer will receive a delivery note in the parcel.
3. Complaint: If the buyer receives the wrong product or if the delivery is incomplete, he/she should contact us at spletna.prodaja@drama.si. In order for us to be able to help the buyer as soon as possible, he/she should provide the order/invoice number and state the reason for complaint. In case the buyer has opted to change the products, the invoice should be ignored as the one received in the new shipment is deemed valid.
4. Returns: Pursuant to the Consumer Protection Act (CPA), natural persons exercise the right to withdraw from a distance contract without stating the reason, and to return the goods. The buyer must notify the SNT Drama Ljubljana of his/her intention to return the goods within 14 days of the day he/she or third party received them at spletna.prodaja@drama.si. The notification must include a request for a refund. Furthermore, the buyer is obliged to return the goods within 14 days. The return of the goods to SNT Drama Ljubljana, Erjavčeva 1, 1000 Ljubljana, together with the form stating the withdrawal from the contract within 14 days of the receipt of the goods shall be deemed a notification of the intended return. The goods must be returned in adequate packaging, with the original label, undamaged and in unaltered condition, and the product must not show any signs of use. The buyer must attach the original invoice and the information necessary for refund (in particular, bank account details). The SNT Drama Ljubljana recommends that the buyer uses a delivery service that allows him/her shipment tracking and make sure that the goods are ready for transport (the buyer may use the original or other suitable and safe packaging). Any return postage charges will be borne by the buyer. The SNT Drama Ljubljana does not accept cash-on delivery. In the event of withdrawal from the contract, the SNT Drama Ljubljana shall return all payments received no later than 14 days after the receipt of the notice of withdrawal from the contract and the goods purchased. The SNT Drama Ljubljana shall return the payments made by the buyer using the same method of payment as used by the buyer, unless the buyer has expressly requested the use of another method of payment and the SNT Drama Ljubljana shall bear no costs as a result. The SNT Drama Ljubljana also allows product replacement. In the event of replacement, the buyer is held responsible for shipping costs.
5. Legal entities. Companies, independent entrepreneurs and other legal entities are allowed to return the products under guarantee terms and conditions. Contrary to natural persons, these organisations cannot withdraw from the contract within 14 days of the receipt date without stating the reason for their return.

Dispute settlement

1. These General Terms and Conditions and any disputes between the SNT Drama Ljubljana and the buyer shall be governed by the Slovenian substantive and procedural law. The rules of international private law that would prove the applicability of any other law shall not apply.
2. The SNT Drama Ljubljana shall attempt in good faith to resolve any disputes. If the disputes cannot be settled amicably, they will be finally resolved by the competent court.
3. In compliance with Article 32(3) of the Out-of-Court Settlement of Consumer Disputes Law (The Official Gazette of the Republic of Slovenia, No. 81/2015, hereinafter referred to as “the Act”), the SNT Drama Ljubljana does not recognise any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the Out-of-court Settlement of Consumer Disputes Act.
4. The SNT Drama Ljubljana as a provider of goods and services enables online trade in the territory of the Republic of Slovenia, in compliance with the Out-of-Court Settlement of Consumer Disputes Law, Regulation (EU) no. Regulation (EC) No 524/2013 of the European Parliament and of the Council on the online settlement of consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22 /ES, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website.
